Did I misread the question? Sounds like he has the original key from the system before he formatted it, but doesn't have a copy of Win98 install CD to install a 'legal' copy of Win98 back onto the system. He can borrow a copy of the Win98 install CD and use the original product key as long as the install CD's are of the same type (OEM, upgrade, full, ect) and be fully LEGAL. I may have misread the Q myself.
But I do know as far as MS is concnerned the EULA is very specific that the key must match the installation disk. In other words yeah almost any key works but lets just say MS on some type of wimsy checks this persons istallation and the key does not specifically match the installation disk then this person could be liable.
Like I said I agree that doing this can be done but lets not make the mistake of saying it is legal. If you don't believe me contact MS. Shouldn't need a lawyer to figure out that it says one license can only be use for one computer. It makes no stipulation that it is ok to install it on another machine where the installation medium may not be available whether the owner of that machine can show proof or not that they did purchase Win98. And note the first paragraph it definitely puts the onus on the user being bound by the EULA if they use the product. Doesn't matter if it is Ma and Pa Kettle, some large company or the 13 year old whiz kid down the block.
Plus when we use our copies of OS's or Software to install on someone else's machine we are putting them at risk (albeit a very minimal risk) of possible prosecution or having to snitch on us. To use the 98SE disk that you have you would have to call Microsoft and order the full version of 98SE since you don't have a copy of 98 to use an upgrade/update disk on and then ask, after ordering, if they have a key for you to use in the meantime but I sincerely doubt they will do this. ANYTHING else would be illegal.Period. End of sentence.
